Over the past two years, at the intersection of legal support and technology a new agenda has emerged: AI content and compliance. Entrepreneurs want to use generative models for marketing, customer service, onboarding and analytics, but they expect transparent rules, legal guarantees and predictable costs. The COREDO team is building exactly these solutions, from legal structuring of AI projects and registering legal entities in the EU/Asia to obtaining financial licenses and implementing AML/sanctions control procedures.

Generative models have radically accelerated content creation, and along with that have increased legal risks. The right to authorship, liability for factual errors and discriminatory inference, labeling of synthetic content, use of personal data – all of this affects contracts, marketing and corporate governance. COREDO’s practice confirms: as soon as a business begins to scale the generation of materials, requirements for transparency and verifiability of the process come to the forefront.

A comprehensive regulatory architecture is forming in the EU. GDPR defines the rules for processing personal data, and the EU AI Act establishes obligations for risk management, transparency and explainability depending on the system’s risk level. For generative models, transparency obligations are particularly important: labeling synthetic content, informing users about interaction with AI and ensuring the demonstrability of decisions when automating significant processes.

Formalizing rights to AI content

Legal formalization of AI content begins with classifying the output. In most jurisdictions the author is considered to be a human, so content entirely created by a model without creative contribution receives limited protection. Our experience at COREDO has shown that a hybrid process with a documented contribution from an editor or designer increases the protectability of the output and reduces IP disputes.

Second layer: Licensing of models and data. Open-source LLMs often come with restrictions on commercial use, limits on modifications and obligations to disclose changes. The solution developed at COREDO includes a compatibility matrix of model and dataset licenses with the client’s business goals to avoid copyright infringements on training samples and comply with distribution terms. We verify dataset provenance step by step (provenance tracking), apply datasheets for datasets and record permissions for use, reworking and synthetic enrichment (synthetic training data).

Attribution and provenance of AI content have operational significance. We implement forensic watermarking and marking mechanisms (watermarking, C2PA-compatible metadata) to track the origin of materials, as well as chain of custody procedures: continuous tracing of file movements between teams and contractors. Such an architecture facilitates the protection of rights, proving authorship and responding to claims related to unfair advertising or misleading conduct.

Generative Content Policy

Corporate AI use policy defines the boundaries of permissibility and roles. I frame it around four blocks: Acceptable Use, responsibilities and roles, quality control, synthetic content labeling. In Acceptable Use we fix a list of tasks where AI content is allowed (for example, drafts of marketing materials) and where separate expertise is required (Legal opinions, personal recommendations in financial services).

the director’s responsibility and C-level responsibility for AI activities we disclose explicitly: we confirm the model owner (Model Owner), appoint a Data Protection Officer and assign a person responsible for model governance (model governance lead). The policy includes rules for labeling AI-generated content on the website and in social networks, as well as requirements for disclaimers in advertising and marketing. The COREDO team has implemented clear templates for clients that are integrated into editorial guidelines and contracts with contractors.

Compliance for Generative Models

Compliance procedures boil down to verifiability. We build them on three tools: impact assessments (impact assessment), model documentation and continuous monitoring. For generative systems we apply AIA (AI Impact Assessment) and DPIA for ML processes, where we evaluate data sources, discrimination risks, explainability and the commercial permissibility of using AI-generated content.

Documentation includes model cards and datasheets for datasets, descriptions of quality metrics, bias management, explainability logs and requirements for interpretability. Into the process we introduce QA for AI: quality control of generative output, escalation rules, test sets of negative and adversarial prompts, as well as prompt engineering from a security perspective. We log prompts and responses in a protected prompt store with masking of personal data and regulate access according to the principle of least privilege.
To measure resilience we apply KRIs, key metrics of legal risk: the share of content requiring mandatory labeling, the share of rejected materials, incidents per 10k generations, incident response time, share-of-voice of negative mentions, and the cost of fixing errors. Such a metric model shows the ROI of compliance and helps adjust processes without delaying the operational cycle.

Personal data protection in AI

GDPR requires privacy by design and privacy by default, and for AI this means data minimization during training and inference, anonymization or pseudonymization and clear documentation of legal bases. We obtain data subjects’ consent when generating personalized content, rely on legitimate interest only when a balancing of interests is performed, and provide an opt-out option.

We support cross-border transfers via SCC/BCR and document international AI regulation and cross-border data in the flows register. In the incident management policy we establish the procedures for notifying about personal data breaches, timelines, roles and notification templates for the DPA and users. COREDO’s practice confirms: early implementation of DPIA procedures, data minimization and access control reduces the costs of subsequent system modernization and helps pass regulatory inspections without stress.

Contractual architecture of LLM providers

Drafting contracts with LLM providers is third-party risk management. I include in contracts SLAs with quality, uptime and security metrics, indemnities and compensation for AI-related damage (including claims related to IP and personal data), clauses on the license for generated outputs and rights to fine-tuned models. Contractual provisions also specify a prohibition on training on user prompts without consent, logging practices and retention periods, as well as subcontractor oversight.

Vendor Due Diligence for AI providers relies on third-party model risk: the provenance of training datasets, the availability of model cards, results of independent tests for bias and robustness, ISO/IEC 27001, 27701 certifications and, where possible, compliance with ISO/IEC 42001 (AI management system). We negotiate corporate agreements on joint IP ownership of models if joint development is planned, and insurance mechanisms — cyber risks, errors and omissions, as well as reputational risks related to deepfakes and synthetic content.

Audit of procedures and resilience

A reliable AI platform relies on continuous auditing. We set up an audit trail and continuous audit of the ML pipeline, record versioning of datasets and models (model change control), coordinate deployment windows and rollback procedures. monitoring tools and MLOps for compliance allow tracking data drift, quality degradation and anomalies in latent space, as well as automatically initiating risk reassessment.

Secure-by-design for ML infrastructure includes network segmentation, secret management, remote signing of artifacts, SAST/DAST for components, protection against adversarial attacks and robustness testing. Operational resilience is complemented by an incident response plan: response scenarios for incidents involving AI content, ready-made messages for users, legal checklists and contact lists of regulatory authorities.

Regulation in the EU and beyond

The EU AI Act introduces risk categories and content requirements. For high-risk systems, risk management systems, data quality, technical documentation, event logging, and human oversight are mandatory. For generative models, the emphasis is on transparency obligations and labeling of synthetic media, as well as on explainability procedures where decisions affect rights and access to services.

Alongside the European Commission, national DPAs and financial regulators (for example, the FSA in some jurisdictions) are active when AI affects payment and investment services. International standards and AI certification help with trust-based demonstration of maturity: ISO/IEC 42001 (AI management system), ISO/IEC 23894 (AI risk management), ISO/IEC 27001/27701 (information security and privacy). A regulatory sandbox provides the opportunity to test a product under supervisory oversight: such an option is especially useful for fintechs and medtechs.

AI and AML in financial licensing

When a service uses AI for payments, trading, digital asset exchange or customer onboarding, licenses come into play: payment services, e-money, investment and forex licenses, crypto licenses (VASP). The solution developed at COREDO combines licensing with AML consulting: we build KYC/AML processes with generative prompts for analysts, while preserving human verification and explainability of decisions.

Regulators pay attention to managing bias and discrimination in models when making decisions about a client’s risk. We implement explainable AI, partly local rules, test fairness metrics and document tolerances. For clients in the EU, Singapore and Dubai, the COREDO team built compliance procedures aligned with FATF standards and national requirements, and also prepared processes for interacting with regulatory authorities and regular reporting.

COREDO Case Studies – Measurable Results

In 2023 an e-commerce holding company approached us that planned to automate product descriptions and banners for the European market. We conducted AIA and DPIA, implemented a labeling policy, model cards, forensic watermarking and QA for the final review. The economics of implementing watermarking and detection proved transparent: an additional 0.3% of the content budget reduced legal incidents to zero within a quarter and sped up publications by 28%. Within six months the client entered new jurisdictions without complaints about advertising using AI generation, and time-to-market for campaigns was reduced by 32%.

Content Generation Compliance Checklist

  • Conduct AIA and DPIA; determine the legal bases for processing and the purposes.
  • Establish a corporate AI usage policy, Acceptable Use policy, and model owner roles.
  • Configure labeling for synthetic content: watermarking, C2PA metadata, visual badges.

Scaling an AI service with compliance

For scaling an AI platform I prefer a two-track approach. The first track, corporate structure: a holding company, operating legal entities in the EU/UK/Singapore/Dubai, and a transparent contractual network allocating IP and risks. The second track, compliance infrastructure: a registry of AI-based solutions, registration of algorithms where required, a cross-border data policy, and centralized control of third-party risk.

The COREDO team has implemented architectures for clients where an EU legal entity holds the IP and licenses, while an Asian company is responsible for R&D and infrastructure. This design simplifies licensing, compliance checks, and tax planning. We synchronize development roadmaps with audit plans and updates to the EU AI Act requirements so that releases do not conflict with regulatory timelines.

EU AI Act readiness audit

I recommend six steps.

  1. Classify AI solutions by risk levels and record them in a registry.
  2. Conduct a gap analysis of requirements: risk management, data quality, documentation, monitoring.
  3. Restructure the development process for privacy-by-design and secure-by-design.
  4. Implement transparency: synthetic content labeling, user notifications, explainability.
  5. Strengthen standards: ISO/IEC 42001/23894/27001/27701, internal policies and staff training.
  6. Plan external validation and, where possible, participation in a regulatory sandbox.

Our experience at COREDO has shown: a 4–6 week pilot audit produces a manageable task backlog, and a subsequent quarterly cycle reduces regulatory uncertainty and accelerates entry into new countries.

Agreement with an LLM without legal risks

At the core of the agreement: nine provisions.

  1. License to outputs and restrictions on training on client data.
  2. Warranties on the provenance of training data and absence of IP infringements.
  3. Indemnity for third-party claims (IP, personal data, defamation).
  4. SLA for quality, response time, retries, and compensation.
  5. Confidentiality, prompt logging policy, retention period, and deletion.
  6. Subcontractor requirements and right to audit.
  7. security measures: encryption, access control, certification.
  8. Incident notification obligations and a joint response plan.
  9. Model change procedures (model change control) and version approval.

We add provisions on explainability labels, a ban on hidden filters without notification, and the right to export the model-selection logic for audit purposes. Such an agreement reduces third-party risk and makes interaction predictable.

Reputational risks and insurance

risk assessment of AI content for business includes legal, operational and reputational vectors. I use KRIs with escalation thresholds and integrate them into C-level dashboards. Insurance for AI-related risks complements control: cyber policies, content liability insurance and separate clauses for deepfakes and synthetic media.

Incident response procedures for AI content include rapid offboarding of erroneous materials, retrospective reviews of prompts, public explanations and policy adjustments. We train staff and certify AI compliance competencies so teams act confidently and consistently.

Legal aspects of e-commerce and advertising

The legal classification of AI content in advertising and marketing depends on the jurisdiction, but the general principle is simple: clear labeling of synthetic content and no misleading claims. We use tools to automatically label AI content on the site, add explanations on product pages, and add provenance labels for reviews and images. The legal qualification of an AI-generated output is supported by expert verification before publication and by storing explainability logs for evidentiary purposes.

When using personalization, consent from data subjects and an easy way to opt out are required. Verifying data sources used to train models in e-commerce is important to prevent copyright claims and unfair competition. Such discipline increases audience trust and simplifies dialogue with regulators.

How to calculate the cost of compliance

The cost of implementing quality-control systems for AI content consists of licenses for labeling and detection, integration of MLOps tools, legal design of contracts and staff training. In COREDO projects, the basic program pays for itself in 4–8 months due to reduced rework, prevented incidents and faster releases. ROI assessment methods rely on comparing the operational cycle before/after, the cost of fixing a single error and the impact of incidents on conversion and brand.

Scaling AI services while maintaining compliance requires managing model changes and versions, a policy for log retention and auditing, as well as best practices for data governance: data lineage, data quality control, access management and dataset review processes.
